The use and sales promoted on the Handsonearth website are governed by the following terms and conditions. When placing an order on Handsonearth, the user:

• You declare that you have read and agreed to these terms and conditions;

• Declares that you are at least eighteen (18) years of age and/or are of legal age in the jurisdiction of your residence, and that you are legally able to contract and will use your own means of payment;

• You will not make fraudulent use of the website, contrary to the law or good customs;

• Accepts that Portuguese legislation will regulate any conflict with the consumer, without prejudice to any provision to the contrary, Community directive or international treaty.

Reproduction, modification, transmission, republication and/or redistribution to third parties for commercial purposes are strictly prohibited without the prior consent of Handsonearth.

The firm Hands on Earth Lda does not allow the use of the website content or its brand for any purpose other than those mentioned above.

STOCK UNAVAILABILITY

Hands on Earth reserves the right to inform the user, within 72 hours of receiving the order, of the unavailability of any item ordered. After informing the user of this unavailability, the contract is considered automatically terminated in relation to the unavailable item, with the user being guaranteed that they will not incur any costs due to the cancellation of the order in relation to the unavailable item, with the amount being cancelled, in due proportion. presented on the user's card account statement. PRICES

All prices on Hands on Earth are shown in EUR €.

The exchange rate used by the company providing the credit card may not be exactly the same as the one presented at the time of purchase.

The price shown for each product does not include transport costs, but does include the VAT rate in force in Portugal (23%).

PRICE CHANGES

Hands on Earth reserves the right to change prices of products for sale.

The prices of the products will, during the placing of an order and its confirmation, be valid throughout this specific process.

When placing an order, the value of the order will be held in the user's card account in favor of Handsonearth. Payment will be debited from the user's card account at the time of dispatch of the items. All transactions carried out on Handsonearth will be redirected to a secure online banking system provided by PAYPAL.

Hands on Earth does not store any card numbers or any type of information related to the payment act.

PAYPAL

Handsonearth accepts payments through PayPal accounts.

MULTIBANK

Users with a bank account at a Banco Português will be able to settle their orders on Handsonearth using the Multibanco payment system.

TAX FREE (EXTRA-COMMUNITY PAYMENTS)

All prices on Handsonearth include VAT at the rate of 23% applied to all intra-community purchases.

For all non-EU countries in Europe and the rest of the world, customs fees may apply. These costs will be the responsibility of the buyer. If these costs are not paid by the buyer and the order has to be returned to Handsonearth, the return cost will be taken from the payment made.

SHIPMENTS AND DELIVERIES

DELIVERY TIMES

Hands on Earth operates from Monday to Friday, with the exception of public holidays.

Delivery times may be slightly longer during sales periods and holidays. With these exceptions, normal delivery times will be:

• Mainland Portugal 3 to 5 business days

– Azores and Madeira 4 to 7 business days

• Europe 5 to 8 business days

IMPORTANT INFORMATION

All orders require a signature upon delivery.

Hands on Earth cannot change the delivery address for orders once they are dispatched.

The delivery times indicated above are merely indicative and do not take into account possible delays caused by problems with payment authorizations or customs clearance in the destination country.

SHIPMENTS AND COLLECTIONS

During the registration process on Handsonearth, the user will have to indicate their personal address details.

Orders will be delivered to the address defined as the user's address. If the user wants Handsonearth to send the order to an alternative address, that address must be indicated when completing the order.

SUCCESSFUL SHIPMENT DELIVERY

The customer is requested to carefully inspect the box upon delivery of all shipments BEFORE signing the delivery document. All Handsonearth packaging is sealed with plastic tape.

If, for any reason, the packaging appears tampered with, please sign the delivery document with reservations, or refuse delivery.

If you accept delivery of the order with reservations, or if you refuse it, please immediately make a complaint to the Carrier and contact Handsonearth via email at info@handsonearth.com.pt.

If, for any reason, the order cannot be delivered to the address provided by the user at the time of purchase, there is a risk that it will be returned to Hands on Earth, at the user's expense. These costs will be deducted from the refund to the user.

If the order is not successfully delivered to the user's address, due to any lack of cooperation from you (wrong telephone number, wrong or incomplete address, non-compliance with import regulations, etc.), in accordance with the commercial agreement with Handsonearth, you may There is a risk that the order will be returned to Portugal, at the user's expense, including any import fees that may be charged upon re-entry into Portugal. These costs will be deducted from any eventual refund.

UNDELIVERED ORDERS

Shipping costs will not be refunded for undelivered orders.

The costs of returning undelivered orders may also be subject to additional charges for taxes and costs or charges levied by customs or other entities which, in no case, will be reimbursed by Handsonearth.

SAFE

Hands on Earth insures each purchase during the transit period, until delivery to the user. All orders require a signature upon delivery, at which point responsibility passes to the user.

If the user designates a recipient other than himself for delivery purposes, then he accepts evidence of a signature as proof of delivery and fulfillment by Hands on Earth and the corresponding transfer of responsibility in the same way.

EXCHANGES AND RETURNS

Devolution:

The User may return the ordered product(s) immediately upon receipt, provided that:

a) The product(s) have not been used;
b) The product(s) maintain their original characteristics, intact labels and security tape (in cases where their existence is verified).
c) The product(s) are complete. All material accompanying orders must be returned.

The customer must request the return of the order via email at info@Handsonearth.com.pt, indicating the item(s) they want to return, as well as the order number.

RIGHT TO FREE TERMINATION OF THE CONTRACT

Hands on Earth recognizes that all its Customers have the right to terminate the Contracts they sign with it, allowing them to return it, within a period of 14 (fourteen) days, counting from the day they acquire physical possession of the Product/s /s or the day on which you acquire physical possession of the last Product, in the case of several goods ordered through a single order and delivered separately, to return your order and without needing to indicate the reason.

Declaration of Resolution

The Customer can complete and send electronically the model form for the Right to Free Resolution provided for in Decree-Law no. 24/2014, of February 14, or any other unequivocal declaration of resolution (“Declaration of Resolution”) through of the communication channels defined in these Conditions.

Return of Products

The return by the Customer (without home collection) of any small and medium-sized Product must be carried out within a maximum period of 14 (fourteen) days after communication of the decision to terminate the Contract under the terms of the Right of Free Resolution, and the Customer must Immediately return the Products in the Order under the terms defined in the chapter relating to exchanges and returns of Products in these Conditions.

Reimbursement

After exercising the Right to Free Termination of the Contract, the refund of the amount paid by the Customer, including, if applicable, the costs that the Customer has paid for the delivery of the Product, will be made via bank transfer, at no cost to the Customer and at the period of 14 (fourteen) days from the knowledge of the decision to terminate the Contract. The refund to the Customer will be paid after validation of compliance with the conditions described in the chapter relating to exchanges and returns of these Conditions and will not pay any fees arising from said refund.

Customers' rights related to compensation or reimbursement of expenses, as well as any contractual or non-contractual liability for direct or indirect damages to people or property, caused by the non-acceptance of an Order, in whole or in part, are found expressly excluded and will not be assumed by Handsonearth.

DAMAGE CAUSED IN TRANSPORT/DEFECTIVE ITEMS

The return of defective items will only be accepted if the items already present the defect at the time of delivery to the user. The Hands on Earth team makes a great effort to carefully check all items to detect any defects in the items before shipping them.

Hands on Earth reserves the right to request photographic support relating to defective items or incorrectly sent merchandise, before authorizing the return, for the purpose of reimbursing transport costs and Import Duties.

All items returned as defective will be properly inspected upon receipt and all items subject to normal wear and tear will not be considered defective.

Defective items will be exchanged for an identical item, in the same color and size, subject to availability. If the user does not wish to have a replacement item sent to them, they must make this request via email at info@handsonearth.com.pt.

The return of defective items must be requested from Hands on Earth within 10 days of receipt.

Refunds for defective items will be made within 10 working days of receipt of the returned items.

If Hands on Earth is unable to replace the defective item, it will refund the amount paid through the payment method originally used, in the same amount paid by the user.
